In our ongoing fight to recover members’ money and protect members’ rights we often have to take the battle for members’ rights to courts and tribunals. WorkChoices has made some bosses think that they can get away with anything. Many bosses have become brazen about breaking contracts with workers. And when bosses turn their backs on their basic legal and contractual obligations to our members then the union is there to take up the fight in courts and tribunals to get your money back.
To ensure even greater success for members we have hired two in-house lawyers who are taking up the fight for your rights in the IRC, in the Magistrates courts and in State tribunals. ‘Having in-house legal experts is good news for members because you know that no matter what happens you will have legal help all the way from the FFTS’, explained FFTS Secretary Leo Skourdoumbis.
Many bosses who hold out on paying redundancy pay and back pay try to hide behind a raft of laws and regulations. At this point an individual worker who has been laid off is concerned simply does not have the financial resources to recover their money through the courts. Their only hope of justice through the courts is through their union lawyer is a sad fact that legal justice is only for the rich in Australia. Proper legal representation costs thousands of dollars. Workers simply can’t afford to fight their boss in the courts to recover back pay or their full entitlements. But using our collective strength the union can give workers some serious legal muscle when they need it.’ said Leo Scourdoumbis.
